Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the www.uxosupplements.com website (the “Service”) operated by UXO Supplements LLC (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.

COMMUNICATIONS

By creating an Account on our service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

PURCHASES

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

We are constantly updating product and service offerings on the Site. We may experience delays in updating information on the Service and in our advertising on other web sites. The information found on the Service may contain errors or inaccuracies and may not be complete or current. Products or services may be mispriced, described inaccurately, or unavailable on the Service and we cannot guarantee the accuracy or completeness of any information found on the Service.

We therefore reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

 

CONTESTS, SWEEPSTAKES, AND PROMOTIONS

Any contests, sweepstakes or other promotions (collectively, “Promotions”) made available through the Service may be governed by rules that are separate from these Terms & Conditions. Free shipping offers or Buy More Save More offers are based upon order subtotals before calculation of shipping or tax. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms and Conditions, the Promotion rules will apply.

CONTENT

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.

You may not use as a username any name that is offensive, vulgar or obscene.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to legal@kagedmuscle.com, with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged Infringement as detailed below, under “DMCA Notice and Procedure for Copyright Infringement Claims”

You may be held accountable for damages (including costs and attorneys’ fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through the Service on your copyright.

DMCA NOTICE AND PROCEDURE FOR COPYRIGHT INFRINGEMENT CLAIMS

UXO Supplements LLC has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that UXO Supplements LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.

TERMINATION

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

INDEMNIFICATION

You agree to defend, indemnify and hold harmless UXO Supplements LLC and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

LIMITATION OF LIABILITY

In no event shall UXO Supplements LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

SUBSCRIPTIONS

Our subscription model is a way to provide additional discounts and offers to our recurring customer base. Customers will receive 15% off of their initial 4 orders (discount not to be combined with any other offer) and a discounted shipping rate of $5. On their 5th order, their discount will be increased to 25% going forward. If a subscription is not cancelled or paused before an order is placed, we will be unable to stop the fulfillment of that order. Customer will need to cancel or pause future subscriptions within their customer subscription portal. This portal can be found on www.uxosupplements.com after signing into their account.

DISCLAIMER

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

UXO Supplements LLC its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

EXCLUSIONS

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of Idaho, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

CHANGES

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

SHIPPING POLICY AND REFUNDS

All orders are processed within 3 to 5 business days (excluding weekends and holidays) after receiving your order confirmation email. Extra time maybe required for larger orders, international orders, orders requiring additional customer information, or out of stock items.You will receive another notification when your order has shipped. 

  • For calculated shipping rates: Shipping charges for your order will be calculated and displayed at checkout. 
  • For simple flat rate shipping: We offer $7 flat rate shipping to USA and  $13 flat rate shipping to APO addresses.

Additional shipping insurance

While not necessary, purchasing shipping insurance is always a good idea. UXO Supplements is not responsible for lost, damaged, or stolen items once the products have left our facilities. With the shipping insurance, UXO will help file the claims to either: get you a reimbursement or replacement product when these things occur. 

INTERNATIONAL SHIPPING

We process orders within 2-3 business days, excluding weekends and holidays. Pre-ordered items are processed within 2-3 business days of arrival in stock.
Successfully placed orders will receive an e-mail confirmation with the order details. If you do not receive an e-mail, please check your spam filter or contact us for confirmation.

If you need any assistance with your order, please contact us immediately. We will not be able to make changes to your order after it has shipped.
Please review and ensure that you have entered the correct address. We are not responsible for non-delivery due to errors in the address that you provide. If an order is returned due to an incorrect address, we will refund the original order (excluding the shipping fee) and ask that you re-submit your order.

CANCELLATION AFTER ORDER

Once an order has been placed, we are unable to guarantee a request to cancel. If a cancellation is requested after an order is placed, we will make every effort to ensure the shipping team tries to halt the package, allowing a cancellation to be processed. If we cannot process the cancellation in time, the customer has the option to return the items after receiving them. However, shipping on the return package must be paid for by the customer. UXO Supplements is not responsible for reimbursement of this charge. 

Refunds Policy

We accept returns up to 30 days after purchase, if the item is unused and in its original condition, and we will refund the full order amount minus the shipping costs for the return. 

In the event that your order arrives damaged in any way, please email us as soon as possible at customerservice@uxosupplements.com with your order number and a photo of the item’s condition. We address these on a case-by-case basis but will try our best to work towards a satisfactory solution.

We will send you an email once your return has been received and inspected to advise you that we have received your returned item. We will also notify you if your refund has been approved or rejected. If you are authorized, your refund will be processed and a credit will be made to your credit card or original mode of payment within a certain amount of days.

Incorrect Shipping Information Provided

If an incorrect shipping address is provided by a customer, the package will in most cases be returned to sender. In this case UXO will reship the product to the corrected address at the expense of the customer. If it is a postal service mistake, the package will be resent and UXO will work with USPS to recoup the additional shipping charge.

Frequently asked questions

Is it free shipping?

Yes! We offer free shipping on our 'limited time flash deal' (Main Campaign page) with the minimum amount purchased (usually around $100 unless otherwise stated). Daily 'limited time flash deal' offers can not be combined with any other offers from any other page. 

How long does it take to receive my order?

Orders will be processed within 1-2 business days (Monday to Friday, excluding holidays). If your order contains any out of stock items, it may cause a small delay to coordinate with the customer on how to proceed. 

How will my order be shipped?

Your order will be shipped by one of these courier services, depending on your shipping address:

What are your shipping costs?

Our shipping costs differ depending on where the order is shipping to and how fast you want it to get there. Priority expedited shipping comes at a premium cost. We do offer flat rate shipping within the Continental U.S. for $7.25.

My order has already been shipped but I need to update the address. What should I do?

Please contact us as soon as possible if you need to change your address. Keep in mind that a rerouting fee may be charged by the courier to change your address. Sometimes, we will be unable to make any change after the order has been submitted.
